WHO DECLARED THAT WHEREAS :

A.MSANE TRIBE HERITAGE TRUST will be claiming the restoration of the land rights in terms of the Restitution Of Land Rights Act Of 1994, of which Msane Tribe ancestors were forcefully evicted on their native land from different places around the Province Of KwaZulu-Natal

And whereas the said pieces of land are now to be transferred to and on behalf of the households, the heads of which are listed on Annexure A and Annexure B above, and their headquarters is based at KwaZoneyane Royal Kraal, eCingci at KwaMsane Tribal Reserve, near Mtubatuba (KwaMsane Township)

B.The heads of MSANE TRIBE HERITAGE TRUST referred to Annexure A and Annexure B above agreed on this day, the 25th July 2014, at KwaZoneyane Royal Kraal, that a trust should be established and be registered to receive transfers of land ownership and immovable property, to hold it on behalf of it's members and descendants as beneficiaries.

Accordingly, this TRUST is constituted in order to take transfers of the land, immovable and movable property on behalf of it's members and descendents of Msane Tribe ancestors or fore-bearers 

C. Furthermore, this TRUST is constituted to:

(a). Regulate the process of lodging land claims collectively.

(b).Manage and administer the trust property and land on behalf of the members and beneficiaries

(c).Regulate the powers of trustees.

(d).Raise, receive, and manage funds to achieve the objectives of the trust

(e).Allocate and regulate membership rights and duties in relation to the Trust Property Control Act 57, Of 1988.

D.All the objectives of the TRUST shall be carried out for the benefit of, and on behalf of households members that are registered and officially recognized by the board of trustees 

NOW THEREFORE THESE PERSONS PRESENT WITNESS THAT :

1.NAME OF THE TRUST

1.1. The name of the trust shall be:

MSANE TRIBE HERITAGE TRUST BOARD

1.2.VISION

To create a nurturing place of love, truth, happiness, and relaxation, and to provide opportunities for each person to become responsibly independent and effectively interdependent in order to achieve worthwhile purpose to be better traditional community.

1.3.MISSION STATEMENT

Our mission is to be actively be of service to each other as an inspirational model of living, and working together to create social change among ourselves, and with the people that we're related to.

1.4.OUR CORE VALUES

To love each other......

To help each other......

To believe in each other......

To wisely use our time, talents, and resources to be a blessing......

To restore our purified traditional and christian way of living and heritage......

2.TRUST ESTABLISHMENT

 A trust is now established for the objectives set out in this Trust Deed.

2.1.This trust shall continue for an indefinite period, terminable in the manner and subject to compliance with the formalities set out below and in compliance with the provision of the Trust Property Control Act 57, Of 1988.

2.2.The trust shall as a legal personae have the power to sue and sued in it's own name.

2.3.The trust deed shall come into existence once has been signed by trust board members.

2.4.The shall have legal personality with the capacity to enter into contracts, acquire, or hold or alternate movable or immovable property.

2.5.The trust shall continue to exist even its members or office bearers change.

2.6.For administrative purpose, the trustees shall establish offices of the trust. There must be a Chief Executive Officer and non serving Secretariat.

2.7.And now therefore, the trust shall also operate and exercise traditional rights within the boundaries of the KZN Traditional Leadership Governance Framework Act, and South African Customary law, to appoint their traditional leadership, and to practising their cultural rituals and activities.

2.8.The trust shall also expand it's scope of network to other tribes within the province, or outside the province.

2.9.The official logo, as identity corporate trade mark of the trust, will look like this

2.10.The trust will also operate with local municipality in accordance with Municipal System Act, as well as local hose of traditional leadeship.

2.11.The trust is now established to address injustice of the past, of appointment of traditional leadeship by colonial government and because of faction fights,to ensure that current democratic government is restoring Msane Tribe indigenous traditional community values.
